Introduced by the Australian Government in 2003, the 132 Business Talent Visa provides a streamlined path for affluent to obtain Australian permanent residency after only 2 years. As of October 2020, the 132 Visa stream offers the only fast track route to Australian permanent residency. (The Australia 188C Visa category offers temporary residency, and requires applicants to subsequently apply for an 888 Permanent Residency Visa after 4 years.)

The 132 Visa stream offers a range of benefits to high net worth foreign investors. For starters, the visa program offers low in-country residence requirements, and the language requirements are far more flexible than with many other comparable Australian investor visa categories. In addition, applicants are not required to hold any tertiary qualifications, and your application will not be subject to any points-based eligibility tests.

Unlike the 188 Visa stream, however, 132 Investor Visa applicants cannot be older than 55 years at the date of application, and there is a requirement for demonstrable business experience. The key benefit of the Australian 132 Visa stream, however, is the fact the investment threshold is far lower than the 188 Visa program, placing it within reach of a far greater number of foreign applicants.

132 Visa Program requirements 2020

The 132 Visa Program requires a minimum investment of AUD 1.5 million, to be held for a minimum period of 2 years. In addition, the secondary complying criteria are outlined as follows: 

  • Minimum asset worth: The assets held by you, your partner and your business must have a minimum combined value of AUD 1.5 million. These assets must have been legally acquired and available for transfer to Australia within 2 years of your 132 Visa being granted.

  • Minimum net asset worth: A minimum of AUD 400,000 must be derived from an ownership interest in one or more of the qualifying businesses, gained over at least 2 of the 4 fiscal years preceding your nomination to apply for the 132 Visa Program.

  • Minimum ownership requirement: In order to be eligible to apply, your ownership stake must be either a minimum of 51% of a business with less than AUD 400,000 per annum, a minimum of 30% of a business with a turnover of more than AUD 400,000 per annum or a minimum of 10% of a publicly listed company.

  • Minimum turnover: A minimum turnover of AUD 3 million must be generated across at least 1 business, but across no more than 2 business during at least 2 of the 4 fiscal years preceding your invitation to apply for the 132 Visa Program being issued. 

  • Program nomination: Each Australian state and territory government agency has their own nomination criteria. However, you don’t need to settle in the state through which you’re nominated.

Additional 132 Visa Program eligibility requirements 2020

  1. MINIMUM AGE REQUIREMENT: Applicants must be at least 18 years, and may not be older than 55 years at the date of application.

  1. MAKE AN ELIGIBLE INVESTMENT: A minimum complying investment of at least AUD 1.5 million, to be held for at least 2 years, is required.

  1. CLEAR CRIMINAL RECORD: Applicants must have a clean criminal record in their country of origin, and must be of impeccable international standing.

  1. LEGAL SOURCE OF FUNDS: Applicants will be required to prove that their source of funds for the qualifying investment was legitimately sourced. 

  1. COMPREHENSIVE DUE DILIGENCE VETTING: Thorough Know Your Customer (KYC) and Anti Money Laundering (AML) checks will be conducted during the application process. Politically Exposed Persons (PEPs) are not eligible to apply, nor are individuals featured on any international criminal watch lists.

The 132 Visa application process at a glance

STEP 1: Preparation of your 132 Visa application: The initial consultation by your Australian investment immigration service provider involves a personal needs assessment, and key eligibility checks are conducted.

STEP 2: Expression of Interest (EOL): Your Expression of Interest is compiled and submitted.

STEP 3: Applicant nomination: The process of nomination and being nominated by an Australian Territory government or state can take up to 60 business days.

STEP 4:  Application approval: Your application invitation is approved and extended.

STEP 5: Application submission: Your application is submitted, and Medicare enrolment is facilitated. Your eligibility is then assessed by the Australian immigration authorities.

STEP 6: Visa issuance: If successful, your 132A Permanent Residency Visa is granted.

STEP 7: Mandatory investment: A Notification of Investment is issued, after which the mandatory blended investment must be made.

STEP 8: Investment structure completed: The investment structure is then completed in collaboration with your Australian immigration service provider.
